Introduction

The Munchy website (the "Site") is operated by Munchy (hereinafter "Munchy", "we", "us").
By accessing the Site, creating an account, or purchasing our products, you agree to these Terms. If you do not agree, please do not use the Site.

We may update these Terms at any time. The online version is the binding one; continued use constitutes acceptance.

1. PRIVACY

Your use of the Site is governed by our Privacy Policy. It explains what data we collect, why, and how to exercise your rights. In the event of a contradiction, the Privacy Policy prevails regarding personal data.

2. ACCOUNT, AGE & CONDUCT

You agree to provide accurate information and protect your credentials.
The Site is not intended for users under 16.
Prohibited acts include: fraud, illegal use, hacking, scraping, spreading viruses, bypassing security measures, or infringing on our (or third-party) intellectual property rights.

Munchy may suspend or terminate access in the event of a violation.

3. PRODUCTS, PRICES, PAYMENT, SHIPPING, RETURNS

3.1 PRODUCT INFORMATION

Our product pages (ingredients, nutritional values, usage tips) are updated regularly. Photos are for illustrative purposes but stay faithful to the Munchy vibe.⚡

3.2 PRICES & TAXES

Prices are displayed in USD ($). Shipping costs are calculated and displayed before checkout. Sales tax may apply depending on your location. We may modify prices at any time, without affecting orders already placed.

3.3 ORDERS

An order is considered accepted after: (i) payment confirmation, (ii) a confirmation email from us. We reserve the right to refuse or cancel an order for legitimate reasons (fraud suspicion, previous dispute, obvious pricing error, stock unavailability).

3.4 PAYMENT

Payments are processed securely by our providers (e.g., Shopify Payments/Stripe/PayPal). Munchy never has access to your full card numbers. Anti-fraud checks may be performed.

3.5 SHIPPING & DELIVERY

Preparation: within [1–2] business days.
Delivery: estimated [3-5] business days for the USA.
Delays caused by carriers, customs, or force majeure are not our responsibility. Risk of loss transfers to you upon handover to the carrier.

3.6 RETURNS & REFUNDS

Refer to our Refund Policy. In short: you have a right to return within 30 days (sealed bags only). We maintain strict hygiene standards. In case of a defect or error on our part, we will replace or refund you immediately.

3.7 SUBSCRIPTIONS (COMING SOON)

"Subscribe & Save" memberships renew automatically at the chosen interval, at the price in effect on the renewal day. You can modify/cancel anytime before the renewal date via your account (or support). Subscription discounts generally do not stack with other promos unless stated otherwise.

3.8 PROMO CODES & GIFT CARDS

Unless stated otherwise, a code is non-cumulative, non-transferable, non-exchangeable for cash, and valid until its expiration date. Gift cards are non-refundable (except where required by law).

4. INTELLECTUAL PROPERTY & USER CONTENT

All elements of the Site (trademarks, logos 🐻, visuals, text, recipes, design) belong to Munchy or its licensors and are protected by copyright and trademark laws.
Any reproduction, modification, or distribution without written permission is prohibited.

Reviews & UGC: By posting a review, photo, or content mentioning us (e.g., #TasteThePower), you grant us a non-exclusive, worldwide, royalty-free license to use/reproduce it on our channels (website, ads, social media) for the legal duration of rights, respecting your privacy.

5. DISCLAIMERS & LIABILITY

5.1 INFORMATION & INDIVIDUAL TOLERANCE

Our products do not replace a balanced diet. Always check the allergen list. If you are pregnant, nursing, or under medical supervision, consult a healthcare professional.
The Site is provided "as is": we do not guarantee uninterrupted access or zero errors, to the extent permitted by law.

5.2 LIMITATION OF LIABILITY

To the extent permitted by law, Munchy shall not be liable for indirect damages (loss of opportunity, data loss, lost profits).
For direct damages, our total liability is limited to the amount paid for the order giving rise to the claim. Your statutory rights are not affected.

6. THIRD-PARTY LINKS & SERVICES

The Site may contain links to third-party sites (carriers, social networks, payment providers). We control neither their content nor their practices; please review their terms and policies before use.

7. SUSPENSION / TERMINATION

We may suspend or terminate access to the Site in the event of a violation of these Terms, illegal behavior, or request by a competent authority. Termination does not affect obligations arising prior to it (payments due, liabilities, etc.).

8. INDEMNIFICATION

You agree to indemnify and hold Munchy harmless from any third-party claims resulting from your misuse of the Site, violation of these Terms, or infringement of third-party rights.

9. APPLICABLE LAW – DISPUTE RESOLUTION

These Terms are governed by French Law.
In the event of a dispute, please contact our support team first (hello@munchy.com) to find an amicable solution.
If no amicable agreement is reached, disputes shall be submitted to the competent courts.

10. MISCELLANEOUS

If a clause is found invalid, the others remain in effect. Failure by Munchy to exercise a right does not constitute a waiver. You may not assign your rights/obligations without our consent; we may assign them to a group company or acquirer.
